Chiefly, for\u00a0retailers using drop shipping services, <\/span><a href=\"https:\/\/www.avalara.com\/nexus\/?partnersource=0013300001ccPZ8&amp;CampaignID=7010b000001DmDT&amp;lsmr=Direct%20Partner%20Referral&amp;lso=Direct%20Partner%20Referral&amp;referrer=&amp;lastReferrer=www.avalara.com&amp;sessionId=1514999029040\"><span style=\"font-weight: 400;\">determining nexus<\/span><\/a><span style=\"font-weight: 400;\">\u00a0is key because it will help you determine the tax obligation scenario that fits each unique transaction. So, let&#8217;s go over the scenarios.<\/span><\/p>\n<p><b>Scenario 1:<\/b><span style=\"font-weight: 400;\"> If the\u00a0sale occurs in the state where you have nexus, you must collect sales tax from the customer. <\/span><\/p>\n<p><b>Scenario 2:<\/b><span style=\"font-weight: 400;\">\u00a0When neither you nor your drop shipper has nexus in the state, the customer must remit use tax. <\/span><\/p>\n<p><b>Scenario 3:<\/b><span style=\"font-weight: 400;\"> The final case is the most confusing and varies greatly between states, so let&#8217;s break this one down:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you don&#8217;t have nexus in the state in which the sale occurs, but the drop shipper does, the drop shipper\u00a0<\/span><b>could<\/b><span style=\"font-weight: 400;\">\u00a0be responsible for collecting sales tax, depending on whether a resale certificate is accepted, the definition of which can vary by state. Most states accept\u00a0resale certificates and in these, you will be required to collect sales tax. However, if resale certificates aren&#8217;t accepted, like in\u00a0California, Connecticut, Florida, Hawaii\u00a0(and others),\u00a0the drop shipper will be required to collect.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The important take away from this scenario is if you don&#8217;t have nexus in a state, you&#8217;re not necessarily\u00a0off the hook and it is imperative that you and your drop shipper determine who will collect on a state-by-state basis.\u00a0\u00a0<\/span><\/p>\n<h2><b>Are you confused yet?\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">With over 12,000 taxing jurisdictions in the US and each with its own set of rules and rates, there&#8217;s no wonder why new business methods like drop shipping are a constant conversation for businesses and lawmakers. The problem for business owners and retailers especially is that these laws are diverse and ever-changing and\u00a0you\u00a0must keep up\u00a0to remain compliant.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, some jurisdictions accept resale certificates so that they may treat the transaction as non-nexus-creating<\/span><b>. <\/b><span style=\"font-weight: 400;\">This means\u00a0the jurisdiction is<\/span><b>\u00a0<\/b><span style=\"font-weight: 400;\">sure that the transaction is truly for resale, ensuring it is tax-exempt. There are around 11 states that do not participate in the programs that work to this effect (<\/span><a href=\"http:\/\/www.mtc.gov\/Resources\/Uniform-Sales-Use-Tax-Exemption-Certificate\"><span style=\"font-weight: 400;\">Multi-State Sales &amp; Use Tax Exemption Certificate<\/span><\/a><span style=\"font-weight: 400;\">, the allowance of out-of-state certificates, and the <\/span><a href=\"http:\/\/www.streamlinedsalestax.org\/index.php?page=sst-exemption-certificate\"><span style=\"font-weight: 400;\">Streamlined Sales Tax Exemption Certificate<\/span><\/a><span style=\"font-weight: 400;\">\u00a0are the most popular).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another divergence point between states is\u00a0the valuation of the taxable amount. In some states, the full retail price would be taxable, whereas others use the wholesale amount as the tax base. California is even more confusing, as\u00a0sales tax is applied either to the full retail price or the wholesale price plus 10%.\u00a0<\/span><\/p>\n<h2><b>Recommendations for Retailers<\/b><\/h2>\n<ol>\n<li style=\"font-weight: 400;\"><b>Determine Nexus:<\/b><span style=\"font-weight: 400;\"> Find out which states you will be required to collect sales tax, provide your drop shipper with a resale certificate, or make sure your drop shipper is collecting on your behalf.\u00a0To do this effectively, use<\/span><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/50-state-guide-internet-sales-tax-laws.html\"><span style=\"font-weight: 400;\">Nolo&#8217;s 50 State Guide<\/span><\/a><span style=\"font-weight: 400;\"> to help you decide.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Communicate with your drop shipper:<\/b><span style=\"font-weight: 400;\"> Lawmakers, wholesalers, and shippers are in the same state of confusion that you are.
